Direct Tax Code for 2011 has been unveiled by the government on Tuesday. The new Direct Tax Code is expected to make a lot of changes in the corporate as well as personal income tax calculation and planning.

The draft Direct Tax Code along with the Discussion Paper was released in August, 2009 for public comments. The response from various stakeholders has been overwhelming and a number of valuable inputs have been received. CBDT has released the revised Discussion Paper on the draft Direct Taxes Code (DTC), which is being placed in the public domain to seek responses on the modified proposals.


Addressed relate to

1. Minimum Alternate Tax (MAT) on gross assets.

2. Tax treatment of savings - Exempt Exempt Tax (EET) vis-a-vis Exempt Exempt Exempt (EEE) basis.

3. Status of Double Tax Avoidance Agreements vis-a-vis the domestic law.

4. Administration of the General Anti-avoidance Rule (GAAR).

5. Taxation of income from house property on a presumptive basis.

6. Tax treatment of capital gains and tax treatment of non-profit organizations, etc.

According to the discussion paper on the new Direct Tax Code for 2011, indicative tax slabs and tax rates and monetary limits for exemption and deductions proposed in the direct tax code will be calibrated while finalizing the legislation.
